ARP Establishes Legal Fund To Halt Health Care/Cap & Trade

The American Reform Party announced today that it has established a legal fund to prevent the inevitable passage and enactment of both Health Care Reform and Carbon Cap & Trade bills by the Senate. 

On behalf of all American voters opposed to government Health Care Reform, Cap and Trade legislation or have just plain had it with our legislators continually violating our Constitution and their abuse of power bestowed on them by their constituents, has established the Americans Against Legislative Abuse Fund. (AALAF)

The legal fund will raise funds from those individuals, businesses and organizations sympathetic to our cause. The funds raised will be used to mount legal action in the Federal courts to block the enactment of both the Health Care Reform and Cap & Trade bills. In addition to the direct legal fees and costs, the funds will further be used for advertising & promotion to bring about public awareness and to lobby for or cause civil or impeachment proceedings against legislators and appointed officials in Washington responsible for the passage of these bills. The ARP views the inevitable passage of these Bills to be impeachable offenses by legislators or elected officials and un-constitutional on the following basis:

  • The Constitution provides no provision that empowers the Federal Government and/or its legislators to enact Entitlement programs or mandated health care insurance coverage.
  • Under the constitution, all laws are to be drafted by Congress only and submitted to the Senate for final approval. The Senate is not authorized to draft and approve its own legislation
  • That the passage of the health care bill violates and impinges upon the rights, freedoms and general welfare of the public in that it creates undo financial burden, additional taxation and debt which cannot be reasonably  justified, or afforded by the tax payer thereby diminishing our quality of life and liberties.
  • It is a direct violation of the Constitution and our Bill of Rights for either the Congress or Senate to craft and pass legislation which violates state rights or the rights and freedoms of choice of all Americans.
  • The bill directly violates both our Bill of Rights and the Constitution in that it is illegal for the Federal Government to impose or mandate upon the entire American population, under threat of penalty, fines and/or imprisonment, the participation in a government program thereby removing individual rights to freedom of choice.

Our legislators are out of control. They have completely lost sight of their responsibilities and allegiance to their constituents or the Constitution. They have opted to vote what is in their best interest for re-election rather than our best interest & wishes. This opposition is always explained as it was best for the 'Good of The People.' This is NOT what our Founders intended our laid out in our Constitution. A legislator’s authority is a privilege limited by the Constitution and granted solely by the American people to whom they directly answer. Outside of National Security, human and civil rights issues, foreign trade and diplomacy, interstate commerce laws and declarations of war, legislators are constitutionally prohibited from enacting mandated government run Entitlement legislation that directly affects every Americans freedom of choice and rights.

Granted, 200 years ago, Legislators had smaller populations and personal relationship with many of their voters and lacked the technology and luxury of instant communication with voters or the ability to call for a national election, we personally trusted our legislators to implement similar types of laws and programs in our best interest. However, the legislators then would never violate their publics trust let alone pass legislation that would violate the very principles on which our country was founded, the Constitution. This trust is no longer relevant or a grandfathered right of the legislator. Government run Entitlement programs as the proposed Health Care Bill or the massive, intangible and financially irresponsible and destructive CAP & Trade Bill are programs which personally affect every business and individual American. In that regard these bills or programs can and should ONLY be approved by the States and the Voters, NOT the legislators. 

ARP National Chairman Michael Simone said "Although, through the upcoming elections, I have complete faith in the American people to make the necessary changes in our government and its elected officials, it may be too late to prevent or overturn the proposed Health Care Reform or Cap & Trade bills. The only way to insure our legislators tow the line, as the American people adjust and realign the scope and powers of our government, is to use the laws and our constitution to our advantage. By filing a lawsuit we will seek to enjoin the enactment of any Mandated Entitlement Program or Cap & Trade Legislation. It has been far too long that our legislators think they are above the law, our Constitution and the people. It must end now!"
